VICTORY FOR JUSTICE: CALCUTTA HIGH COURT QUASHES DISCRIMINATORY ORDER ( High Court, Calcutta - WPA 8899 of 2026)


A monumental win for the movement! The High Court has cleared the path for restoring recognition and rights to AIPEU Group 'C', proving that bias and abuse of law will not stand against the unity of our comrades.


WPA 8899 of 2026 (All India Postal Employees Union & Anr. Vs Union of India & Ors.), delivered by the High Court at Calcutta, is summarized below:


• The petitioners (AIPEU Group C West Bengal Circle) challenged an office order dated March 19, 2026, which prohibited all postal circles and divisions from corresponding with the de-recognized unions NFPE and AIPEU Group 'C'. 


• Although the petitioners admitted their recognition had been withdrawn, they sought the same "Trade Union facilities" currently extended to another de-recognized body, the Bharatiya Postal Employees Federation (BPEF). 


• The court noted that the Department of Posts had previously granted BPEF facilities such as channels of communication, meetings with senior officers, and office accommodation, despite their lack of recognition. 


• The court determined that since the petitioner unions were on the same legal footing as the BPEF, the order to cease all correspondence with them showed "inherent biasness" and a violation of the principles of natural justice. 


• The discriminatory treatment between two different de-recognized unions was deemed an "abuse of the process of law". 

• Justice Shampa Dutt (Paul) quashed and set aside the impugned order dated March 19, 2026. 


• The court directed the respondent authorities to extend the same Trade Union facilities to the petitioners as those provided to the Bharatiya Postal Employees Federation. 


• The court ordered that an urgent photostat certified copy of the judgment be supplied to the parties expeditiously, provided they apply for it and comply with the necessary formalities. 


• The Court found the Department's refusal to communicate with AIPEU while communicating with other de-recognized unions to be a clear case of "inherent biasness". 


• The judgment explicitly quashed the order that banned correspondence with the union, effectively removing the barrier to official communication. 


• The authorities are now legally directed to extend all Trade Union facilities to AIPEU Group 'C' on par with other federations. 


• The ruling characterized the Department's previous actions as an "abuse of the process of law," reinforcing the union's rightful standing.
