EWS Quota Is 10% Of General Seats Not Of Total Vacancies: HC

MADHYA PRADESH HIGH COURT HAS SAID THAT THE QUOTA FOR ECONOMICALLY WEAKER SECTIONS (EWS)
 IS LIMITED TO 10% OF THE GENERAL SEATS AND NOT 10% OF THE TOTAL VACANCIES FOR WHICH RECRUITMENT TEST IS ORGANISED. 

While dismissing a petition filed by candidates Ankush Mishra, Pushpedra and others, the bench of Justice Vivek Agarwal said that Professional Examination Board (PEB) was right in calculating the seats reserved for EWS.

The petitioners said that PEB had advertised 219 posts of lab technicians. Their contention was that with 10% reservation for EWS candidates, 22 posts should have been reserved for them but only four persons were given appointment under EWS quota.

During hearing of the petition, the court found that of 219 vacancies, 122 posts were reserved for OBCs, 46 for SCs and 13 for STs. 

There were 34 general seats. The court said that EWS reservation is for poor candidates from general castes, so 10% of general seats would be reserved for them and not 10% of the total seats. The court recently held PEB was right in reserving 4 seats for EWS candidates and dismissed the petition.
