⚖️ Important Supreme Court Judgment on DA & Pensioners
The Supreme Court of India has ruled that the State cannot treat serving employees and pensioners differently when granting Dearness Allowance (DA) / Dearness Relief (DR).
🔹 The Court held that inflation affects both employees and pensioners equally.
🔹 Giving higher DA to serving staff and lower DR to pensioners is arbitrary and discriminatory.
🔹 Such differentiation violates Article 14 (Right to Equality).
🔹 Financial constraints may delay implementation, but once granted, equal treatment is mandatory.
📌 Case Example: In Kerala State Road Transport Corporation, employees were given 14% DA while pensioners got only 11% DR. The Court upheld pensioners’ right to equal enhancement.
